Local Democracy, Economic Development and Construction Act 2009 - New Construction Act
The above, otherwise known as the New Construction Act came into force on the 1st October 2011 and makes significant amendments to the Housing Grants, Construction and Regulations Act 1996.
One aspect of the Act is to make unenforceable, contract clauses that state retention monies are not payable until a third party certificate is issued, thus ending "Paid when Paid" and "Pay when Certified" clauses.
